The US and UK are opening new dialogue regarding data and progress on data adequacy. Data adequacy is a status provided by the European Commission to countries outside the European Economic Area (EEA) who provide a strong level of personal protection when it comes to data. Through this relationship, the two nations will work together and with other partners, to fully realize the advantages of technological advancement and data protection.
On October 7, US Department of Commerce Secretary Gina Raimondo met with the UK’s State Secretary for International Trade Kemi Badenoch and spoke about the “ongoing collaboration to strengthen the US-UK bilateral and commercial relationship.”
The technology partnership has been in progress over the course of the past year and during that time, made important progress on shared priorities, including:
- Promoting bilateral and globally-interoperable frameworks for cross-border data flows, and support for data innovation.
- Deepening the collaboration on semiconductors and addressing supply chain vulnerabilities.
- Deepening the cooperation on telecommunications supply chain diversification through a US-UK Telecommunications Supplier Diversity Working Group.
- Addressing risks posed by AI and delivering on the AI Research and Develop Cooperation Declaration.
- Setting out plans for a closer working relationship on quantum information sciences and technology.
In December 2021, both countries committed to accelerating and broadening discussions on how the benefits of improved bilateral and globally-interoperable cross-border data flows can be realized. Since then, the UK has released the “Enhancing Safeguards for United States Signals Intelligence Activities” and aims to release a data adequacy decision to restore a stable and reliable mechanism for US-UK data flows.
The US, meanwhile, intends to designate the UK as a qualifying state under an Executive Order (EO) from President Biden, enabling UK individuals who submit qualifying complaints to access the mechanism. Through these actions, the countries will be able to facilitate a strong relationship to work on multilateral initiatives, build trusted global data flows and increase “trust in the lawful government access to data for law enforcement and national security purposes,” the press release states.
“This is a significant step forward in our work on bilateral cross-border data flows, which will facilitate the free and secure flow of personal data from the UK to the US,” Commerce said in the press release.
“We are working together to ensure that a deal on US-UK data adequacy upholds the rights of data subjects, facilitates responsible innovation, gives individuals in both countries access to the services that suit them, reduces burdens on businesses and delivers better outcomes for people.”
